Hosting Terms of Service
Zanlus offers storage and transfer services over the Internet through access to its web server. Client utilizes the web server for its own purposes and at their own risk. Both parties recognize that Zanlus neither owns nor controls the Internet and that Zanlus makes no guarantee that any individual will be able to access the web server at any particular time. Zanlus will make every reasonable effort to ensure that its server is widely available and with limited service interruption.
Contract
The terms and conditions of this statement constitute the contract between Zanlus and the Client for the purpose of web hosting. Client certifies that they are eighteen years of age or older and are able to engage in contractual agreement.
Materials
Client assumes complete responsibility for content posted to their allocated space. That responsibility includes, but is not limited to: creation and formatting of content, claims made in that content, all legal issues relating to that content (including illicit material and materials which violate intellectual property) the use of bandwidth and server space, and scripting.
Zanlus respects the Client's right to network neutrality and will exercise no action over the Client's content except under the following circumstances:
- The content impedes the ability of Zanlus or Zanlus' other clients to use the web server.
- The content is illicit.
- The content violates intellectual property rights.
Zanlus servers are not to be used for any of the following activities:
- Any application that listens for inbound network connections.
- Attempts to disrupt network operations of Zanlus or any other network. This provision includes but is not limited to port scanning and Denial Of Service attacks.
- BitTorrent clients, proxy servers or scripts, IRC bots, and IRC bouncers.
Zanlus is not responsible for any damages that may be suffered by the Client which result from the Client's errors. Zanlus specifically limits damage claims to the Client for non-accessibility time or other unscheduled down time to a pro-rated monthly charge. Scheduled down time cannot result in damage claims.
Financial Considerations
Client agrees to a 12 month contract, beginning on the day when service began. All hosting services are prepaid. Client agrees to hold only one hosting service agreement. Multiple plans are grounds for immediate termination and may carry penalties.
Client may cancel services within the first ninety days of original contract for any reason. A pro-rated refund will be made to the Client within one month of cancellation notification. After the ninety-day introductory period, termination of the agreement by either party requires thirty day notification. The refund will not include the month of notification.
At the end of the contract term, the contract will automatically renew for an additional year indefinitely until canceled in writing.
Violations of Terms of Service or other stated policies may, at Zanlus' discretion, result in immediate disablement without refund.
All relevant taxes are the responsibility of the Client.
Equipment
Zanlus is not responsible for provision of any hardware or other equipment required to access Zanlus' server. Zanlus further explicitly denies any responsibility for compatibility of Client's equipment with Zanlus' server.
Limited Liability
Client agrees to the liability limitations previously stated or inferred in this contract.
Recovery of damages are limited to the sum of prepaid services under the specific terms of the current contract. No liability shall be carried over from previous contracts.
Contract Revisions
Revisions to these terms of service will be applied to all previous terms. Renewal of service as specified above will be considered acceptance of revisions.
